Terms of Service

These Terms of Service govern your use of GemLynks, a private jewelry marketplace operated by GemLynks LLC.

By creating an account or using GemLynks, you agree to these terms.

GemLynks is a marketplace that connects private sellers and buyers of fine jewelry. GemLynks does not own, buy, sell, or take possession of any jewelry listed on the platform.

Sellers are solely responsible for the accuracy of their listings, including but not limited to:

• Accurate description of the piece
• Authenticity of certificates and documents
• Accurate representation of stone quality, treatment, and origin
• Accuracy of any grading information provided

GemLynks makes no representations about the accuracy of seller listings.

GemLynks is not responsible for:

• The quality, safety, or legality of items listed
• The accuracy of listings
• The ability of sellers to sell items
• The ability of buyers to pay
• Any disputes between buyers and sellers
• Any losses arising from transactions conducted through the platform

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEMLYNKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

GemLynks charges a commission on completed transactions:

• Sales: 8% of the final sale price
• Exchanges: 4% per party
• Upgrades: 5% on listed price + 8% on cash difference

No upfront fees are charged.

The following items may not be listed:

• Stolen or misappropriated jewelry
• Counterfeit or fraudulently described items
• Items with forged certificates
• Synthetic stones represented as natural
• Any items prohibited by applicable law

In the event of a dispute between buyer and seller, GemLynks may at its discretion assist in facilitating communication but is not obligated to resolve disputes and shall not be liable for any outcomes.

Any seller found to have deliberately misrepresented a listing may be permanently banned from the platform. GemLynks reserves the right to remove any listing at any time.

These terms are governed by the laws of the State of Florida, United States.

GemLynks reserves the right to modify these terms at any time. Continued use of the platform constitutes acceptance of updated terms.
